Auto-Mate Mechanical & Repairs Terms & Conditions

1. GENERAL

This document sets out the Terms & Conditions upon which Auto-Mate Mechanical & Repairs Pty Ltd (ABN 82 780 665 179) provides services to you. By engaging with our services, you agree to these Terms & Conditions. A contract ("Agreement") is formed between Auto-Mate Mechanical & Repairs Pty Ltd ("we," "us," or "our") and the customer ("you").

This Agreement commences when you sign a Service Authorisation form or verbally approve the services we will perform. By agreeing to our Estimate and Service Authorisation, you are accepting these Terms & Conditions.

2. ESTIMATES

You agree:

  • The labour, parts, costs, and time frame provided in the Estimate are only estimates.
  • The Estimate is binding once approved by you, either verbally or in writing.
  • We may amend the Estimate, and these changes supersede previous estimates. Amended estimates can be approved verbally or in writing.
  • The Estimate is valid for 7 days from the issue date but may be subject to changes in the cost or availability of parts.
  • All prices include GST unless stated otherwise.
  • Special order parts or second-hand parts require payment upfront before the order is placed.
  • Freight costs may apply for ordered-in parts.
  • We may request a 50% deposit for estimates exceeding $1,000, payable upon your approval.

3. INVOICES AND PAYMENTS

  • An invoice will be issued upon the completion of services.
  • All prices include GST unless otherwise specified.

           You agree:

  • To pay the total amount due on the day we notify you that your vehicle is ready for collection unless otherwise agreed.
  • Payment methods include cash, EFTPOS, or credit card (we do not accept cheques unless agreed in advance).
  • We reserve the right to vary the purchase price if you provide incorrect or late information or request additional services.
  • If your financial status changes (e.g., bankruptcy or liquidation), this Agreement terminates, and all outstanding amounts become immediately due.
  • You may not withhold payment of any invoice due to a dispute unless agreed in writing by us.

4. FAILURE TO PAY, STORAGE, LIEN, & UNCOLLECTED GOODS

If you do not pay in full when your vehicle is ready for collection:

  • We may exercise a lien over your vehicle, retaining possession until all amounts owed are paid in full.
  • A storage fee of $10 per day will be charged from the date we notify you that your vehicle is ready for collection.
  • If the outstanding amount is not paid within six months, we may sell or dispose of your vehicle in accordance with the Disposal of Uncollected Goods Act.
  • We will not be responsible for any loss resulting from the sale or disposal of your vehicle under these circumstances.

5. PARTS AND WARRANTY

  • We use quality aftermarket parts that meet or exceed manufacturer specifications unless genuine parts are specifically requested.
  • Special order and second-hand parts require upfront payment and are non-refundable.
  • Second-hand parts come with a 3-month parts-only warranty, unless otherwise stated. Labour is not covered under warranty for second-hand parts.
  • New parts come with a 6-month parts and labour warranty, unless otherwise specified.
  • Warranty does not apply to wear and tear, maintenance items, misuse, or damage from unsafe driving practices.
  • We reserve the right to refuse to fit customer-supplied parts ("owner-supplied parts"). If we agree, you warrant that the parts are free from defects and are suitable for installation.

6. PERFORMANCE OF SERVICES

  • We will provide services as outlined in the Service Authorisation or as updated by your instructions.
  • We reserve the right to cancel or postpone appointments if necessary due to unforeseen circumstances.
  • We will not be liable for any loss or damage to your vehicle or its contents while it is in our possession unless directly caused by our negligence.

7. AUTHORITY TO USE VEHICLE

You authorise us to:

  • Test drive your vehicle for service purposes.
  • Sublet some or all services and deliver/collect your vehicle from subcontractors if necessary.

8. FORCE MAJEURE

We are not responsible for any failure or delay in providing services due to circumstances beyond our control, including strikes, fires, floods, cyber-attacks, or any disruptions to utilities.

9. TITLE OF GOODS

Ownership of parts or products installed does not transfer to you until payment is made in full. We may register a security interest over the vehicle until full payment is received.

10. LIABILITY

  • We are not liable for injury, death, loss, or damage caused by the use of products or services provided by us, except where liability is imposed by law.
  • We are not responsible for the loss or damage of any items left in your vehicle.

11. DISPUTE RESOLUTION

  • Initial Resolution: In the event of any dispute or disagreement arising from these Terms & Conditions or our services, you agree to first contact us directly at 0403 411 700. We will aim to resolve your concerns amicably and promptly.
  • Written Notification: If the dispute cannot be resolved informally, you must provide written notice to us detailing the nature of the dispute, including relevant facts and any supporting documentation. This notice should be sent to admin@automatemechanical.com.au.
  • Response Time: Upon receiving your written notice, we will acknowledge receipt within 5 business days and will work to investigate and respond to your concerns within 14 business days.
  • Communication Requirement: You agree that you must communicate with us regarding any issues or disputes related to our services before seeking assistance or services from another workshop. If you proceed to engage another workshop without first notifying us of the dispute and allowing us the opportunity to address the issue, you understand and agree that you forfeit any right to compensation for any monies paid out to the other workshop.
  • Confidentiality: Both parties agree to keep all aspects of the dispute and its resolution confidential, including any settlement terms reached through mediation.
  • Consumer Rights: Nothing in these Terms & Conditions limits your rights as a consumer under the Australian Consumer Law or any other applicable consumer protection legislation.

12. AMENDMENTS

We reserve the right to amend these Terms & Conditions at any time. Any amendments will be effective immediately upon being published on our website.

13. INDEMNITY

You indemnify us against any loss, damage, liability, or claim that we may suffer as a result of any breach of this Agreement by you or any third-party claim made against us in relation to the products or services provided, except to the extent such loss or liability arises due to our negligence or breach of this Agreement.

14. PRIVACY POLICY

We will collect and handle your personal information in accordance with our Privacy Policy, which is available upon request. Your personal information will be used to provide the services requested and may also be used for internal administration purposes. By agreeing to these terms and conditions, you consent to our use of your personal information in this manner.

15. VARIATION

We may amend these terms and conditions at any time, and any changes will be notified to you in writing or verbally. You agree to be bound by the terms and conditions as amended from time to time.

16. GOVERNING LAW

This Agreement is governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising under this Agreement.
